Terms of Use

These Terms govern your use of the WhiffCheck app and website (the "Service"), operated by Perfumes & Beauty USA LLC, a Florida limited liability company ("we", "us"). By creating an account or using the Service you agree to these Terms and to our Privacy Policy.

1. Eligibility and accounts

You must be at least 13 years old (or the minimum age in your country) to use the Service. You are responsible for your account and for keeping your password secure. Give accurate information and do not impersonate anyone.

2. Community rules — zero tolerance

We do not tolerate objectionable content or abusive users. You agree not to post, submit or link to content that:

is hateful, harassing, threatening, sexually explicit, violent or otherwise offensive;
is spam, advertising or misleading, including fake ratings or manipulating scores;
infringes anyone's copyright, trademark or other rights;
contains anyone's private information;
is unrelated to the perfume it is attached to.

You can report content from within the App. We review reports within 24 hours and will remove content that breaks these rules and suspend or terminate the accounts responsible.

3. Your content

You keep ownership of what you contribute (ratings, lists, suggestions, video links). You grant us a worldwide, non-exclusive, royalty-free license to use, display and aggregate it to operate and promote the Service, including in each perfume's public score. Creator videos are shown through the official TikTok or Instagram players; we do not download or re-host them, and the video owners keep all their rights. We may remove any content at our discretion.

4. Perfume information, dupes and scores

Perfume details, notes, "dupes"/alternatives and similarity percentages are provided for general information, may contain errors and reflect community opinion. A "dupe" or "inspired by" label describes a scent comparison only; it does not mean the products are related, endorsed or equivalent. Brand names and trademarks belong to their owners and are used only to identify products.

5. Stores and purchases

Buy links take you to third-party stores (including Ezenzia and partner retailers, some of which may be affiliated with us). Purchases, prices, shipping and returns are handled by those stores under their own terms. We may earn a commission. We are not responsible for third-party websites or products.

6. Acceptable use

Do not misuse the Service: no scraping, automated access, reverse engineering, attempts to break security, or use that disrupts the Service or other users.

7. Termination

You can stop using the Service and delete your account at any time in Settings. We may suspend or terminate accounts that break these Terms.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law. Fragrance can cause skin reactions; always check product ingredients and labels.

9. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, and our total liability for any claim relating to the Service is limited to US$100.

10. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Miami-Dade County, Florida, unless the law of your country requires otherwise.

11. Apple

If you downloaded the App from Apple's App Store, these Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide support, and is a third-party beneficiary of these Terms with the right to enforce them. Your use must also follow the App Store Terms of Service.

Estos Términos regulan el uso de la app y el sitio de WhiffCheck (el "Servicio"), operados por Perfumes & Beauty USA LLC, Florida, EE. UU. Al crear una cuenta o usar el Servicio aceptás estos Términos y la Política de privacidad.

1. Cuentas

Tenés que tener al menos 13 años (o la edad mínima de tu país). Sos responsable de tu cuenta y tu contraseña. No te hagas pasar por otra persona.

2. Reglas de la comunidad: tolerancia cero

No toleramos contenido ofensivo ni usuarios abusivos. No publiques ni enlaces contenido de odio, acoso, amenazas, sexual explícito o violento; spam, publicidad o calificaciones falsas; contenido que infrinja derechos de autor o marcas; datos privados de otras personas; o contenido que no tenga que ver con el perfume. Podés reportar contenido desde la App: revisamos los reportes dentro de las 24 horas, quitamos el contenido que rompa estas reglas y suspendemos o damos de baja las cuentas responsables.

3. Tu contenido

Lo que aportás sigue siendo tuyo. Nos das una licencia mundial, no exclusiva y gratuita para usarlo, mostrarlo y combinarlo en los puntajes públicos para operar y promocionar el Servicio. Los videos se muestran con los reproductores oficiales de TikTok e Instagram; no los descargamos ni los volvemos a publicar.

4. Información, dupes y puntajes

Los datos de perfumes, notas, dupes y porcentajes de similitud son informativos, pueden tener errores y reflejan la opinión de la comunidad. Que algo sea "dupe" o "inspirado en" solo describe una comparación de aroma: no implica relación, aval ni equivalencia entre marcas. Las marcas pertenecen a sus dueños.

5. Tiendas y compras

Los links de compra llevan a tiendas de terceros (incluidas Ezenzia y tiendas asociadas, algunas vinculadas a nosotros). Precios, envíos y devoluciones dependen de cada tienda. Podemos recibir una comisión.

6. Uso aceptable, baja y responsabilidad

No hagas scraping, acceso automatizado ni intentes vulnerar la seguridad. Podés borrar tu cuenta cuando quieras en Ajustes; podemos suspender cuentas que incumplan estos Términos. El Servicio se ofrece "tal cual", y nuestra responsabilidad se limita a lo que permita la ley, con un máximo de US$100.

7. Ley aplicable y Apple

Rigen las leyes del Estado de Florida, EE. UU. Si descargaste la App desde la App Store, este acuerdo es entre vos y nosotros, no con Apple, que no es responsable de la App pero puede hacer cumplir estos Términos.
